- The Collaborative Process is voluntary and uses mediation as a home base to help clients figure out all financial and parenting topics and come to agreements without needing to going to court to have a judge decide the case. Having a nuetral person facilitate spouse/parent meetings is super-efficient and more likely to help resolve differences.
- In the Collaborative Process, attorneys are used in a more limited way, to focus on what they do best (and no more), including providing legal advice, drafting court documents and processing the case with the court. Let's not duplicate efforts with two attorneys doing the exact same work twice.
- Collaborative Professionals will respect each client’s self-determination, recognizing that ultimately the clients are responsible for making the decisions. This is your life and your family!
- The Collaborative Process requires the full and affirmative disclosure of all Information that is reasonably required for the clients to make informed decisions. Information is shared more freely, for greater efficiency and understanding, than in the traditional court process.
- The Collaborative Process requires clients and professionals to comply with all reasonable requests for information. We don't resist sharing information. We won't hide the ball. This isn't a game.
- Collaborative Professionals will assist the clients in establishing realistic expectations. Unsupported high expectations are a recipe for prolonged disagreements.
- Each client and all Collaborative Professionals take a thoughtful and constructive approach on all unresolved questions in the interest of reaching agreements. We take a problem-solving win-win approach, rather than a winner-take-all approach.
- No client or professional takes advantage of inconsistencies, misunderstandings, miscalculations, omissions, or inaccurate assertions of fact, law or expert opinion. We are here to help you make good, informed decisions, not to take advantage of anyone.
- The clients jointly hire experts as needed, rather than each hiring their own experts. This saves time and money.
- Clients who select the Collaborative Process have a reasonable expectation that their case can and will be resolved by an agreement that is acceptable to both clients. If the clients reach a sticking point where they can't agree on something, the professionals will encourage the clients to reconsider or create options that would be acceptable to both clients.
