What is an "Uncontested Divorce" and how does that differ from Mediation and Collaborative Divorce?
Uncontested Divorce is a popular search term online. It doesn't have a specific definition. Probably most people intend for it to mean an amicable or cooperative divorce where the couple works together to avoid an ugly and expensive court battle. So, it would be the opposite of a contested divorce, which is a divorce where the people disagree and they contest the issues involved and need to each try to prove their version is correct to the court. It could be said that an uncontested divorce is a divorce without going to court because you reach agreements on all the topics.
Sometimes the best way to proceed is by working together to complete a Joint Petition for Divorce. This is the process used in Collaborative Divorces. In other cases, couples choose to move forward without doing a separate Joint Petition for Divorce and instead wait until the end and do a combined document called a Joint Petition and Agreement.
